INFORMATION CLAUSE – RECIPIENTS OF NEWSLETTER

We hereby would like to inform you that we process your personal data in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”). Details are given below.

1. Data controller is Statscore Sp. z o.o. with its registered office in Katowice Poland, at Dworcowa 2 40-012 Katowice, National Court Register No 447881 (hereinafter “Data Controller”” or “Statscore”).

2. Purpose and legal basis for personal data processing
Your personal data in the form of your e-mail address shall be processed for the purpose of sending you Statscore Pulse newsletter based on your consent (pursuant to art. 6 (1) point (a) of the GDPR).
We strive to constantly improve our services, so we want to provide you only with personalized and interesting information, and to achieve this we may use profiling. In the case of profiling, the basis for processing is the legitimate interest of the Data Controller (pursuant to Article 6(1) (f) of the GDPR).
3. Your personal data may be transferred to and processed by:

3.1.authorised employees and associates of the Data Controller;

3.2. service providers supplying us with technical, IT and organisational solutions that enable us to pursue business activity, including our websites and electronic services provided through them (in particular e-mail and hosting providers and providers of systems for automation and management of newsletter service;

3.3. entities duly authorized to do so under universally applicable provisions of law.

4. Transfer of personal data to third countries or international organisations
We use services of MailChimp to send out our newsletters. The provider is the Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA. Thus whenever you enter data for the purpose of subscribing to a newsletter the information is stored on MailChimp servers in the United States. A standard clause agreement with MailChimp regarding data protection according to the GDPR is in place that aims to warrant the compliance with European data protection standards in the United States. accordance with art. 46 sec. 2 GDPR. 5. Automated decision-taking, including profiling
With the assistance of MailChimp tool we can analyze the performance of our newsletter campaigns. If you open an e-mail that has been sent through MailChimp tool, a file that has been integrated into the e-mail (a so-called web-beacon) connects to MailChimp’s servers. As a result, it can be determined whether a newsletter message has been opened and which links the recipient possibly clicked on. Technical information is also recorded at that time (e.g. the time of access, the IP address, type of browser and operating system). This information cannot be allocated to the respective newsletter recipient. Their sole purpose is the performance of statistical analyses of newsletter campaigns. The results of such analyses can be used to tailor future newsletters to the interests of their recipients more effectively. For more details, please consult the Privacy Policies of MailChimp.

6. Data retention period – data you provide us for the purpose of the newsletter subscription shall be processed by us until you unsubscribe from the newsletter. Once you cancel your subscription to the newsletter, the data shall be deleted. This shall not affect data we have been archiving for other purposes. Consent to the processing of personal data may be withdrawn at any time by clicking the link that allows to unsubscribe that can be found in the footer of every newsletter email.

7. Submission of data is fully voluntary but necessary for the purpose stated purpose, and the consequence of failing to provide the data will be the inability of Statscore to send you the newsletter.

8. You have the right to access your data and obtain copy, the right to request that they be rectified or erased, the right to restrict their processing, the right to data portability and the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, right to object at any time to the processing of your personal data insofar as the basis for the processing of personal data is our legitimate interest. You are entitled to these rights in the scope provided for in generally applicable provisions of law. You have the right to lodge a complaint with the supervisory authority in charge of personal data protection in the Member State of your habitual residence, place of work, or place of the alleged infringement if the processing of personal data violates personal data protection laws. KLAUZULA INFORMACYJNA – SKIEROWANA DO ODBIORCÓW NEWSLETTERA

Zgodnie z art. 13 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 roku („RODO”), pragniemy przekazać Państwu najważniejsze informacje dotyczące przetwarzania Państwa danych osobowych.

1. Administratorem Państwa danych osobowych jest Statscore Sp. z o.o. z siedzibą w Katowicach, przy ul. Dworcowej 2 40-012 Katowice, KRS 0000447881 (dalej „Administrator” lub „Statscore”).

2. Cel i podstawa prawna przetwarzania danych osobowych
Pozyskane przez nas bezpośrednio od Państwa dane w postaci adresu e-mail będą przetwarzane w celu realizacji wysyłki drogą elektroniczną naszego newslettera Statscore Pulse, w oparciu o wyrażoną przez Państwa zgodę na prowadzenie takich działań (podstawa prawna art. 6 ust. 1 lit. a) RODO). Dążymy do ciągłego ulepszania naszych usług, dlatego chcemy dostarczać tylko interesujące Państwa spersonalizowane informacje i aby to osiągnąć możemy korzystać z profilowania. W tym przypadku podstawą prawną przetwarzania jest nasz prawnie uzasadniony interes (art. 6 ust. 1 lit. f RODO).

3. Państwa dane osobowe mogą być przekazywane:

3.1. upoważnionym pracownikom i współpracownikom Administratora;

3.2. podmiotom zaopatrującym Administratora w rozwiązania techniczne, informatyczne oraz organizacyjne, w szczególności dostawcom poczty elektronicznej i hostingu oraz podmiotom świadczącym usługi i dostarczającym narzędzia z zakresu obsługi klienta, w szczególności dostawcom systemów do automatyzacji usługi newsletter na zasadzie zleconych usług;

3.3. podmiotom upoważnionym do tego na podstawie obowiązujących przepisów prawa.

4. Przekazanie danych osobowych do Państw Trzecich
Administrator przewiduje przekazywanie danych osobowych do Państw Trzecich. Aktualnie przy wysyłce naszego newslettera korzystamy z usług MailChimp. Dostawcą jest Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA. Dlatego gdy wprowadzasz dane w celu zapisania się do newslettera informacje te mogą być przechowywane na serwerach MailChimp w Stanach Zjednoczonych. W celu zagwarantowania zgodności z europejskimi standardami ochrony danych zastosowane zostały mechanizmy zabezpieczeń oparte o standardowe klauzule umowne zgodnie z art. 46 ust. 2 RODO. 5. Zautomatyzowane przetwarzanie danych (w tym poprzez profilowanie)
Państwa dane osobowe mogą być przetwarzane w sposób zautomatyzowany (w tym w formie profilowania), ale w takim przypadku nie będzie to wywoływać wobec Państwa żadnych skutków prawnych lub w podobnym zakresie istotnie wpływać na Państwa sytuację. Profilowanie danych osobowych przez Administratora polega na przetwarzaniu danych do oceny niektórych informacji na Państwa temat, w tym analiz, statystyk lub prognozy zainteresowań oraz osobistych preferencji, a także w związku z prowadzoną przez nas działalnością marketingową. 6. Okres przechowywania danych
Państwa dane osobowe będą przetwarzane do czasu otrzymania informacji o wycofaniu zgody. Zgoda może być wycofana w każdym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na jej podstawie przed wycofaniem.

7. Podanie danych osobowych jest całkowicie dobrowolne i uzależnione od Państwa zgody, lecz niezbędne do otrzymywania naszego newslettera.

8. Przysługuje Państwu prawo dostępu do treści swoich danych, żądania sprostowania danych, usunięcia danych lub ograniczenia ich przetwarzania, w przypadkach przewidzianych prawem, uzyskania kopii swoich danych, przeniesienia danych osobowych, wycofania w dowolnym momencie zgody na przetwarzanie danych, wniesienia w dowolnym momencie sprzeciwu wobec przetwarzania Państwa danych osobowych, w zakresie w jakim podstawą przetwarzania danych osobowych jest nasz prawnie usprawiedliwiony interes, w tym ze względu na Państwa szczególną sytuację, wniesienia skargi do organu nadzorczego, tj. na terenie Polski Prezesa Urzędu Ochrony Danych Osobowych, gdy uznają Państwo, że podczas przetwarzania danych naruszyliśmy przepisy RODO.
