In accordance with the disposition of Article 13 and Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”), we kindly inform you that:
1. Data Controller of your personal data is Statscore Sp. z o.o. Węglowa 9, 40-106 Katowice, National Court Registry Number 447881, hereinafter also referred to as “Statscore”.
2. Purpose and legal grounds for the processing of personal data:
2.1. professional handling of complaints regarding failure to ensure compliance with accessibility requirements, handling of other inquiries and compliance with any other legal obligations of Statscore in the field of ensuring accessibility. The legal basis for the processing of your personal data are Article 35-37 of the Act of 26 April 2024 on ensuring compliance with the requirements for the availability of certain products and services by business entities (Journal of Laws of 2024, item 731, hereinafter referred to as the “Act”) in connection with Article 6(1)(c) of the GDPR,
2.2. archiving correspondence for evidentiary purposes, defense against possible claims and in order to demonstrate compliance with legal obligations, which constitutes the implementation of the legitimate interests of the controller (Article 6(1)(f) of the GDPR).
3. Personal data contained in correspondence may be made available to:
3.1. authorized employees and persons cooperating with Statscore,
3.2. entities that process personal data for Statscore (processors), in particular IT support companies and entities maintaining software used in the course of current operations,
3.3. entities authorized on the basis of relevant provisions of law, in particular entities of the supervision system referred to in Article 38 of the Act.
4. Personal data will not be transferred to and stored outside the European Economic Area (EEA)
5. The data will not be subject to automated decision-making, including profiling.
6. We will process personal data for the entire period of examining the complaint and then for a period not exceeding 3 years for archiving and evidence purposes.
7. Submission of name and surname, correspondence address, e-mail address or telephone number, along with an indication of the preferred method of contact with the consumer, indication of the product or service to which the complaint relates and indication of the accessibility requirement that the product or service does not meet is obligatory and necessary to handle the request or answer the question. A complaint that does not contain this information is left without consideration (Article 36(3) of the Act). In the remaining scope, providing other data is voluntary.
8. We have received personal data directly from you or personal data may have been provided to us by a distributor who, in accordance with Article 35(3) of the Act, is obliged to immediately forward the received complaint to a business entity for consideration.
9. Within the limits and on the terms set in Articles 12-22 of the GDPR, the data subject has the right to access the content of the data, rectify it, limit its processing, object, request deletion and, if the administrator considers that the data processing regulations, the right to lodge a complaint with the President of the Office for Personal Data Protection. PRZETWARZANIE DANYCH OSOBOWYCH OSOBY ZGŁASZAJĄCEJ BRAK SPEŁNIENIA WYMAGAŃ DOSTĘPNOŚCI
Realizując dyspozycję art. 13 oraz art. 14 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) („RODO”), uprzejmie informujemy, że:
1. Administratorem Państwa danych osobowych jest Statscore Sp. z o.o. z siedzibą w Katowicach, ul. Węglowa 9, 40-106 Katowice, KRS 447881, dalej również jako “Statscore”.
2. Cel i podstawy prawne przetwarzania danych osobowych:
2.1. profesjonalna obsługa skarg na niezapewnianie spełniania wymagań dostępności i innych zapytań oraz realizacja wszelkich innych obowiązków prawnych związanych z realizacją zadań i obowiązków z zakresu zapewnienia dostępności. Podstawą prawną przetwarzania Państwa danych osobowych są art. 35-37 ustawy z dnia 26 kwietnia 2024 roku o zapewnianiu spełniania wymagań dostępności niektórych produktów i usług przez podmioty gospodarcze (Dz.U. z 2024 r. poz. 731, dalej „Ustawa”) w zw. z art. 6 ust. 1 lit. c RODO,
2.2. archiwizacja prowadzonej korespondencji w celach dowodowych, obrony przed ewentualnymi roszczeniami oraz w celu możliwości wykazania spełnienia obowiązków prawnych co stanowi realizację prawnie uzasadnionych interesów administratora (art. 6 ust. 1 lit. f RODO).
3. Dane osobowe zawarte w zgłoszeniu mogą być udostępnione:
3.1. w ramach struktury wewnętrznej upoważnionym pracownikom i współpracownikom Statscore,
3.2. podmiotom, które przetwarzają dane osobowe na rzecz Statscore (podmioty przetwarzające), w szczególności firmom wsparcia w obszarze IT oraz podmiotom utrzymującym oprogramowanie, wykorzystywane w ramach bieżącej działalności,
3.3. podmiotom upoważnionym na podstawie odpowiednich przepisów prawa w szczególności podmiotom tworzącym system nadzoru o których mowa w art. 38 Ustawy.
4. Dane osobowe nie będą przekazywane i przechowywane poza Europejskim Obszarem Gospodarczym (EOG)
5. Dane nie będą podlegały zautomatyzowanemu podejmowaniu decyzji, w tym profilowaniu.
6. Będziemy przetwarzać dane osobowe przez cały okres rozpatrywania skargi a następnie przez okres nieprzekraczający 3 lat w celach archiwalnych i dowodowych.
7. Podanie danych w zakresie imienia i nazwiska, adresu do korespondencji, adresu e-mail lub numer telefonu wraz ze wskazaniem preferowanego sposobu kontaktu z konsumentem, wskazaniem produktu albo usługi, których dotyczy skarga oraz wskazaniem wymagania dostępności, którego nie spełniają produkt albo usługa jest obligatoryjne i niezbędne do obsługi zgłoszenia lub odpowiedzi na pytanie. Skargę, która nie zawiera tych informacji pozostawia się bez rozpatrzenia (art. 36 ust. 3 Ustawy). W pozostałym zakresie podanie innych danych jest dobrowolne.
8. Dane osobowe otrzymaliśmy bezpośrednio od Państwa lub mogły zostać przekazane nam przez dystrybutora, który zgodnie z art. 35 ust. 3 ustawy zobligowany jest do niezwłocznego przekazania otrzymanej skargi do rozpatrzenia podmiotowi gospodarczemu.
9. W granicach i na zasadach wynikających z art. 12-22 RODO, osobie której dane dotyczą, przysługuje prawo dostępu do treści danych, ich sprostowania, ograniczenia przetwarzania, sprzeciwu, żądania usunięcia oraz, jeżeli uzna, że administrator narusza przepisy dotyczące przetwarzania danych, prawo skargi do Prezes Urzędu Ochrony Danych Osobowych.
